Buying New Construction in Fulshear, TX: Your Questions Answered

by Amalia Ohe

Newly built two-story brick and stone home in a master-planned community in Fulshear, TX

Fulshear has many master-planned communities with homes from several builders. Buying new is exciting, but the builder's process, contract, and fees are different from a resale purchase. Here are direct answers to the questions buyers ask before they visit a model home.

Do I need my own agent to buy from a builder?

It's a smart idea. The builder's sales consultant works for the builder, not for you. Your own agent helps compare builders, negotiate incentives, review the contract, and keep inspections and deadlines on track. Many builders require your agent to come with you, or register you, on your first visit, so contact your agent before you walk into a model home.

Can I negotiate with a builder?

Often, yes, though not always on price. Builders more commonly offer closing cost help, rate buydowns, or design center upgrades, especially on move-in-ready ("spec") homes. What's available changes by builder, community, and time of year. We ask for incentives in writing before you sign.

Do I have to use the builder's lender?

No. You can choose any lender. Builders sometimes tie incentives to their preferred lender, so compare a Loan Estimate from the builder's lender with one from an outside lender. Then pick the better overall deal, counting the rate, fees, and incentive together.

Do I need an inspection on a brand-new home?

Yes. New homes can have missed items too. Consider phase inspections: before the foundation is poured, before drywall goes up, and a final inspection before closing. Then schedule a warranty inspection before your builder's first-year warranty ends. Some homes outside city limits may have fewer government inspections, which makes your own inspector even more important.

What does the builder warranty cover?

It depends on the builder, so read the written warranty. Many builders cover workmanship for one year, major systems for two years, and structural items for up to ten years, each with its own limits and claim process. Keep a list of issues and submit claims in writing before deadlines pass.

Are MUD taxes higher in new Fulshear communities?

They can be. New communities often use MUDs to pay for new roads, water, sewer, and drainage, and rates can change over time. Your contract should include a MUD notice. We compare the total tax rate and HOA dues across communities so you see the real monthly cost.

How long does it take to build, and what if it's delayed?

A move-in-ready home can close in weeks. A to-be-built home often takes several months, depending on the builder, weather, and permits. Builder contracts usually allow for delays, so plan your lease or current home sale with some cushion and keep your rate lock in mind.

Is the builder's contract the same as a regular Texas contract?

Usually not. Most builders use their own contract forms instead of the standard TREC forms. Builder contracts often require larger deposits and may make some deposits, like design upgrades, non-refundable. Read every page before signing, and talk to a real estate attorney if you have legal questions.

Which school district serves new Fulshear communities?

Fulshear-area communities can be zoned to Lamar CISD or Katy ISD, and new schools and boundary changes happen as the area grows. Confirm the assigned schools for a specific address with the district.

Frequently asked questions

What is a spec home? A home the builder started before it had a buyer. It's often move-in ready or close to it.

What is a lot premium? An extra charge for a lot the builder considers more desirable because of size, location, or view.

Should I worry about what's built behind my lot? Ask the builder for the community plan and what's planned for nearby open land, such as future phases, roads, or commercial sites.
