Buying New Construction in Cypress, TX: Your Questions Answered

New home under construction among tall pine trees in Cypress, TX

Cypress, in unincorporated northwest Harris County, has many large master-planned communities and active builders. Because there's no city government, a few things work differently for new homes. Here are direct answers to the questions buyers ask most.

Who inspects new homes in unincorporated Cypress?

Unincorporated areas generally have fewer government building inspections than cities. Many builders use third-party inspectors, but those inspectors work for the builder. Hire your own inspector for phase inspections before the foundation is poured, before drywall, and before closing. Then schedule a warranty inspection before your first-year builder warranty ends.

Are new Cypress homes built above flood levels?

After Hurricane Harvey, Harris County adopted stricter elevation rules for new homes in floodplains in unincorporated areas. Still, risk is specific to each lot. Ask for the lot's FEMA flood zone and elevation certificate, and review the Harris County Flood Control District's flood information for the area. Get a flood insurance quote, since NFIP policies usually take 30 days to start.

Why are property taxes in new Cypress communities so different?

New communities rely on MUDs (Municipal Utility Districts) for water, sewer, roads, and drainage, and some also pay ESD (Emergency Services District) taxes and HOA dues. Rates vary by community and can change. Plan for a possible tax increase after the first year if the home was taxed mostly on lot value at first. File your homestead exemption with the Harris Central Appraisal District after you move in.

Do I need my own agent with a builder?

The builder's sales consultant represents the builder. Your agent represents you in comparing builders and communities, negotiating incentives, reviewing the contract, and tracking inspections. Many builders require your agent to be with you, or to register you, on your first visit, so reach out before touring models.

Can I negotiate, and do I have to use the builder's lender?

Incentives such as closing cost help, rate buydowns, or upgrades are common, especially on move-in-ready homes. You can choose any lender. If an incentive is tied to the builder's preferred lender, compare Loan Estimates to find the better overall deal.

What's in a builder's contract and warranty?

Most builders use their own contracts instead of the standard TREC forms. These often include larger deposits, delay terms, and non-refundable upgrade deposits. Warranties vary, and many cover workmanship for one year, systems for two, and structure for up to ten. Read both documents fully, and talk to a real estate attorney with legal questions.

Which school district serves new Cypress communities?

Most new Cypress-area communities are zoned to Cypress-Fairbanks ISD, but some are in Waller ISD or Tomball ISD, and new schools can shift boundaries. Confirm the assigned schools for a specific address directly with the district.

Frequently asked questions

What is an ESD tax? An Emergency Services District tax that helps fund fire and EMS in unincorporated areas.

What is a lot premium? An added charge for a lot the builder considers more desirable, such as a larger lot or one backing to green space or water.

What's planned behind my lot? Ask the developer for the master plan, the timing of amenities, and future roads or commercial sites.
